These Terms & Conditions (“Terms”) govern your booking and participation in tours operated by Vidura Yala Safari (“we”, “us”, or “our”) via yalasafarijeeptour.com. By confirming your booking and making a payment, you acknowledge and agree to be bound by these Terms.

2. Wildlife Sightings Disclaimer Natural Environment:
Yala National Park and its surrounding blocks are natural wild habitats. All wildlife sightings are entirely dependent on the free movements, natural habits, and behaviors of wild animals in their native environment.
No Guarantees: While our experienced trackers make every professional effort to read footprints, alarm calls, and behaviors to locate iconic apex predators, wildlife sightings (including leopards, elephants, and sloth bears) can never be guaranteed.
Environmental Variables: Animal activity varies based on daily weather conditions, park traffic levels, and natural cycles. By booking, guests explicitly accept that sightings are not assured and agree that no refunds, discounts, or compensation will be issued if specific animals are not observed.
3. Health, Fitness, & Safety Compliance Physical Conditions:
Safari activities involve traversing rough, unpaved terrain in custom 4×4 vehicles, early morning starts, bumpy tracks, and long durations. Guests should ensure they are in appropriate physical condition to participate safely.
Medical Disclosures:
Any pre-existing medical conditions, back or neck vulnerabilities, pregnancy, or mobility issues must be fully disclosed to our team prior to booking.
Assumption of Risk:
Participation in our safari tours is entirely at your own risk. Guests must strictly always follow all driver/guide instructions and Department of Wildlife Conservation Park regulations.
4. Meals & Dietary Requirements Add-On Meals:
For selected tours where optional breakfast or lunch add-ons are ordered (such as traditional Sri Lankan rice & curry), Vidura Yala Safari can only accommodate vegetarian and vegan dietary requests.
Exclusions: We do not cater to any other specialized dietary requirements, including but not limited to gluten-free, nut-free, or specific allergy-related meals.
Guest Responsibility: Guests with severe food allergies or complex dietary restrictions are strongly advised to bring their own meals and snacks inside the jeep cool boxes.
Liability Limit: We accept no liability for any health issues arising from food consumption, and absolutely no refunds or compensation will be provided for unmet dietary expectations.
5. Mandatory Insurance Required Coverage:
While Vidura Yala Safari includes individual local life insurance coverages up to 500,000 LKR per passenger within our jeep service, this does not replace the requirement for extensive international travel insurance. Standard protection provided automatically via credit card companies is not considered sufficient coverage.
6. Force Majeure Uncontrollable Events:
We are not liable for any delays, itinerary changes, or non-performance caused by events completely beyond our reasonable control.
This includes, but is not limited to natural disasters, acts of war, strikes, pandemics, sudden government closures, civil unrest, or severe weather conditions.
7. Limitation of Liability Financial Cap:
To the fullest extent permitted by local law, the maximum liability of Vidura Yala Safari for any loss, injury, or damage is strictly limited to the total amount paid by the client for the tour.
Negligence & Encounters: We accept absolutely no liability for death, personal injury, property loss, or damage resulting from a guest’s own negligence, unpredictable wild animal encounters, or the independent actions of third parties.
8. Photography & Media Release Promotional Content:
By participating in our safaris, you grant your consent to be photographed or digitally recorded by our team for marketing and promotional purposes.
Opt-Out: If you prefer not to appear in any promotional photos or videos on our website or social media channels, you must inform us explicitly in writing before your scheduled safari departure.
9. Governing Law Jurisdiction:
These Terms & Conditions are governed exclusively by the laws of Sri Lanka. Any disputes, claims, or legal proceedings arising from your booking will be subject to the exclusive jurisdiction of the Sri Lankan courts.
